Jennifer is an intellectual property litigator and co-chair of Winston & Strawn’s highly regarded Intellectual Property Practice. She represents clients in a wide variety of industries in copyright, DMCA, trademark, trade dress, design patent, right of publicity, and internet-related disputes. She is known as an industry leader in copyright and trademark litigation and counseling and is consistently recognized by The Legal 500 US, Chambers USA, The Best Lawyers in America®, and World Trademark Review. 

Jennifer has represented a number of the leading internet service providers and technology companies in cutting edge copyright and trademark cases. She also has more than two decades of experience litigating trademark, trade dress, design patent, and unfair competition cases in a wide variety of industries, including Internet and technology, consumer goods, and food and beverage.

Notably, Jennifer served as lead counsel for Office Depot in copyright litigation brought by Great Minds concerning educational materials subject to Creative Commons licenses and the proper scope of the Creative Commons license. She and her team obtained dismissal of the case on the pleadings in the Central District of California and Jennifer successfully argued the appeal to the Ninth Circuit.

Jennifer has been widely recognized for her work as a Leading Partner in copyright litigation in The Legal 500 US (2013–2024), in which a client commented that she “sets the gold standard for punctiliousness and professionalism.” In 2024, Jennifer was ranked in Chambers USA for her California copyright and trademark practice. She is listed in The Best Lawyers in America® for her work in entertainment law (2014–2025) and intellectual property litigation (2024–2025).  She was selected as an “IP Star” by Managing IP (2021–2024); and she has also been repeatedly named among the world’s leading trademark practitioners for both litigation and prosecution by the World Trademark Review (2011–2025), in which she is described as “engaged, sharp-witted and thorough” whose “insights are hugely valuable when you have important business decisions to make.” She “can be relied on for vigorous support in the toughest cases.”

Key Matters

Significant representations include:

  • Recently secured dismissal of a vicarious copyright infringement claim brought by the music industry against one of the largest internet service providers in the U.S. that sought a billion dollar plus damages award for the alleged infringing activities of the ISP’s subscribers.
  • Lead counsel for Office Depot in copyright litigation brought by Great Minds concerning educational materials subject to Creative Commons licenses. Won dismissal of case on pleadings in the Central District of California and successfully argued appeal in the Ninth Circuit.
  • Lead counsel for European entities Ocom and LeaseWeb in litigation brought by Perfect 10 alleging claims of direct and secondary copyright infringement in connection with CDN and web hosting services.
  • Defended leading retailers against allegations that certain footwear carried in stores and online infringed on design patents, trademarks, and trade dress associated with a leading footwear company’s products. 
  • Represented Veoh Networks in obtaining summary judgment for Veoh regarding its entitlement to safe harbor from plaintiff’s claims of direct and indirect copyright infringement under Section 512(c) of the DMCA. Both decisions affirmed on appeal.
  • Represented a prominent electronic components manufacturer in successfully obtaining a TRO and preliminary injunction in patent litigation over screen protectors.
  • Represented Bare Escentuals Beauty, Inc. in a number of trademark and false advertising litigations in the Northern District of California.
  • Obtained a ruling holding that Google’s use of framing and hyperlinking was a fair use.
  • Obtained summary judgment for Veoh regarding its entitlement to safe harbor from plaintiff’s claims of direct and indirect copyright infringement under Section 512(c) of the DMCA.
  • Represented a well-known individual as plaintiff in case involving claims of trademark infringement, right of publicity, and cybersquatting, and resulting in recovery of key domain names.
  • Represented a technology company in in rem action under the Anti-cybersquatting Consumer Protection Act, resulting in recovery of key domain names.
  • Represented Clearplay Inc. in litigation involving cutting edge copyright and trademark claims challenging Clearplay’s distribution of DVD player control software.
  • Represented eBay, Inc. in copyright and trademark infringement and DMCA litigations in the Northern District and Central District of California.
  • Represented prevailing plaintiff in, granting injunctive relief in connection with the defendants’ cybersquatting and trademark infringement.
