Joe Motto Discusses DEI Policy Disclosures with Bloomberg Law
Winston & Strawn partner Joe Motto was quoted in a Bloomberg Law article discussing diversity, equity, and inclusion (DEI) policy disclosures following President Trump’s executive orders targeting the initiatives in the private sector and the lawsuit against Target Corp. alleging that the company failed to adequately disclose to investors the risk that its 2023 Pride-themed marketing campaign could turn off customers. DEI strategies can refer broadly to campaigns for social awareness, such as selling merchandise or promoting statements in support of underrepresented communities, or narrowly to internal company hiring policies.

Acting Patent Trial and Appeal Board (PTAB) Director Coke Stewart was sworn in on January 20, 2025, rescinded the prior Director’s discretionary denial guidance on February 28, 2025, and implemented new guidance and a new discretionary denial briefing schedule between March 24 and 26, 2025. See here. Decisions on requests submitted under the new process are anticipated to start rolling out soon. The Patent Office reported receiving more than 40 requests for discretionary denial under the new process as of April 17. The process gives petitioners one month to respond to the requests and the PTAB another month to provide a decision.

The Illinois Biometric Invasion of Privacy Act (BIPA), enacted in 2008, grants Illinois consumers the right to their own biometric data, such as fingerprints, retina or iris information, voiceprints, and DNA. Under the BIPA, private companies are prohibited from collecting biometric information unless (1) the person consents in writing and (2) the companies inform the person in writing of what data is being collected, for what purpose, and for how long. Besides the notice and consent requirement, the law also bans any company from selling or otherwise profiting from consumers’ biometrics.

The Illinois Genetic Information Privacy Act (GIPA), enacted in 1998, prohibits employers and their agents from conditioning employment on genetic data, or from using genetic data in discriminatory ways. The statute also prohibits insurers from seeking genetic information to use in connection with accident or health insurance policies.
