Winston regularly partners with human resource professionals, in-house attorneys, and managers for employers nationwide to resolve issues in all areas of labor and employment law, including trade secrets, leaves of absence and disability accommodations, employee discipline and termination, and wage and hour compliance.

Winston regularly advises clients on risk management and class action avoidance strategies. An integral part of his practice involves working with clients to defend against wage and hour litigation and developing policies and practices aimed at averting class, collective, and representative actions under the California Private Attorneys General Act (PAGA). As second-chair, he secured a jury trial victory in a class action in which plaintiffs sought more than $100 million for alleged non-compliant meal and rest breaks.

In addition, Winston regularly defends employers in single plaintiff and multi-plaintiff lawsuits against claims of whistleblower retaliation, wrongful discharge, as well as harassment discrimination, retaliation and disability accommodation claim. He handles litigation in state and federal courts throughout California, as well as in arbitration proceedings and before administrative agencies.

Winston received his J.D., cum laude, from the University of San Francisco School of Law in 2015, where he was the editor of the Maritime Law Journal. He earned his B.A. from the University of California, Davis in 2009.
