Recent developments continue the trend of the National Labor Relations Board (Board) expanding its influence over labor disputes. First, the Board signed an agreement with the Occupational Safety and Health Administration (OSHA) under which OSHA will refer time-barred complainants under the Occupational Safety and Health Act to the Board. Second, as part of an unlawful termination ruling, an NLRB Administrative Law Judge struck down an employer’s mandatory arbitration agreement, nondisclosure agreements, and numerous employee handbook rules as unlawful under federal labor law.
