John Rosenthal, chair of Winston & Strawn’s eDiscovery and Information Management Practice, participated in PLI’s Electronic Discovery Institute 2015: What Corporate and Outside Counsel Need to Know on September 2, 2015

The demands and costs of eDiscovery continue to grow. Nearly every case now involves some sort of eDiscovery, and it is essential to know how to effectively and fairly handle the many issues that can arise. The seminar provided an inside look at the current state of eDiscovery, shared tips for avoiding pitfalls litigants have encountered in the years since the passage of the federal rules, and discussed important ethical issues in light of court decisions imposing discovery sanctions and outlining the duties of outside and in-house counsel.

Mr. Rosenthal spoke on the panel “Data Privacy and eDiscovery.” The session addressed:

  • Data Privacy – what are we talking about?
  • Domestic Issues – Impact of federal and state privacy and data transfer laws and regulations
  • International Issues – Possession, custody, and control and conflict between U.S. discovery obligations and foreign data privacy laws

Other seminar topics included:

  • Technology-Assisted Review: Where Are We and Where Are We Going?
  • Amendments to the Federal Rules of Civil Procedure
  • Ethics in eDiscovery
