Winston’s eDiscovery & Information Governance Practice (eDiscovery Group) is one of the United States’ largest and most experienced. Per The Legal 500 US 2024, “[Winston has] a very strong practice from top to bottom. Our eDiscovery Group includes highly experienced partners, e-discovery attorneys, review attorneys, legal services attorneys, project managers, and technologists, all of whom are dispersed across the firm’s offices. Our team brings years of experience navigating difficult e-discovery issues in the context of complex litigation, high-stakes government and regulatory investigations (e.g., SEC, DOJ, HHS, OIG), and large-scale collections and reviews of electronically stored information (ESI) for many Fortune 500 clients.

Areas of Focus

We have full-service e-discovery advisory practice within our firm’s own walls that can address our client and case e-discovery requirements at every stage of the Electronic Discovery Reference Model (EDRM). Our “People, Process, and Technology” approach focuses on defensibly eliminating the volume of ESI to promote efficiency, and reduce costs from the discovery of ESI. We are highly experienced in conducting e-discovery against custodial and non-custodial unstructured data sources (e.g., MS Office, Google Suite, Slack) as well as structured data sources (e.g., applications and systems such as Workday, SAP, Salesforce, Oracle, Jira).

We utilize the latest industry tools, for more information view our tech stack.

We have created our own managed review capability, staffed by our highly experienced, lower-cost review attorneys, who employ our cutting-edge analytical tools and review processes. With over 200,000 review hours per year, we can deliver high-quality document review services at rates competitive with outsourced legal service providers. Our managed review team is comprised of attorneys with years of experience designing and conducting large, complex reviews. We also can deliver witness kits, deposition materials, and trial exhibits. Our reviews are driven by the latest artificial intelligence capabilities to include predictive coding, inclusive reviews, threaded reviews, and short message format (e.g., chat reviews). Our managed review team spends a significant amount of time conducting second-level review and management of outsourced legal service providers. Given that privilege identification and review are the single largest cost of discovery, we have adopted processes, procedures, and tools to conduct privilege reviews and logging. We conduct foreign-language reviews and translation and offer specialized, case-specific reviewers to address complicated and/or technical areas, such as those arising in patent and trademark cases.

Our eDiscovery Group acts as national counsel for multiple companies across a wide variety of industries. Designating one firm as national counsel for e-discovery issues eliminates the time-consuming need for a company to educate multiple law firms on its IT infrastructure and records-retention policies and ensures consistency in the company’s approach to e-discovery. Having a subject matter expert with significant courtroom skills that you can drop into any case when needed can be a real differentiator that reduces risk and saves costs.
