On August 7, President Trump signed an Executive Order directing the DOL, the SEC, and Treasury (including the IRS) to review and revise guidance to facilitate the inclusion of alternative investments—such as private equity, cryptocurrency, and other non-traditional assets—in defined contribution retirement plans. The Executive Order follows action in May of this year by the DOL to rescind its 2022 guidance that discouraged fiduciaries from including cryptocurrency options in 401(k) retirement plans.

Debanking—closing accounts or refusing to open accounts for customers perceived to be high risk—has become a hotly debated topic in recent years among groups on both sides of the political aisle. The debate involves allegations that banks have improperly debanked customers for political, rather than risk-based, reasons. Such accusations have shined a spotlight on banks’ account management practices, resulting in changes to regulatory practices and a new executive order from President Trump requiring additional regulatory changes and investigations. All of which will mean increased risk for financial institutions.

What Is the Foreign Corrupt Practices Act (FCPA)?
The Foreign Corrupt Practices Act (FCPA) is a federal statute prohibiting United States citizens and entities from engaging in corruption. It has two main elements: (1) anti-bribery provisions, forbidding the giving or offering of anything of value to a foreign government official for business and (2) accounting requirements, establishing mandatory practice guidelines for companies to maintain accurate records and internal controls. The FCPA is enforced by the Department of Justice (DOJ) and the Securities and Exchange Commission (SEC).
