What Is Children’s Privacy Law?
An important children’s privacy law in the U.S. is the Children’s Online Privacy Protection Act (COPPA). COPPA requires the Federal Trade Commission to issue and enforce regulations concerning the online privacy of those under age 13. The Commission’s first COPPA Rule took effect in 2000, and an amended Rule took effect in 2013. The primary goal of COPPA is to place parents in control over personal information collected from their children online. Its Rule applies to commercial websites, online services, and mobile apps that collect, use, or disclose children’s personal information. The Act applies to websites designed for children’s use but can also apply to general audience sites. Additionally, the Family Educational Rights and Privacy Act (FERPA) is a federal law that prevents the sharing of personal student data and educational records with third parties without parental consent. However, the law does allow schools to share student information with some types of educational vendors and consultants.

What Is Communications Privacy Law?
Communications privacy law in the U.S. is addressed in the Electronic Communications Privacy Act (ECPA) and within other federal laws, such as the Telecommunications Act. The ECPA of 1986 makes it a crime to intercept wire, voice, or electronic communications. The Act also outlines interception procedures involving law enforcement. The Stored Communications Act, which is often referred to in conjunction with ECPA, protects electronic communications’ privacy and determines how government may legally access stored communications.

A privacy audit, also known as a privacy compliance audit, is an assessment tool that looks at an organization’s privacy protection policies and procedures, specifically in light of current relevant laws or regulatory requirements. The audits may be conducted by private organizations or by government agencies that are verifying a company’s regulatory compliance. In terms of privacy audit law, the FTC can conduct audits of organizations and take action when a company is improperly securing private information. Action is taken under the FTC Act, which covers unfair trade practices. Health Insurance Portability and Accountability Act audits are also conducted to ensure that providers are following HIPAA law and protecting private health information.
