Rapid Ruling: Fifth Circuit Affirms Winston Win on Summary Judgment the Day After Oral Argument
Winston recently secured a total victory for our clients, KVP Energy Services, LLC and other affiliated defendants, at the U.S. Court of Appeals for the Fifth Circuit. Plaintiff BHI Energy I Power Services LLC filed suit in the U.S. Northern District of Texas in September 2022, alleging US$150M in damages in connection with causes of action for misappropriation of trade secrets, unfair competition, and various other business torts and statutory violations. Winston scored an important early win in January 2023 by defeating BHI Energy’s motion for preliminary injunction. After a year of extensive discovery, Winston moved for full summary judgment on behalf of all defendants. In a strongly worded opinion, the district court granted Winston’s summary judgment motion and dismissed the entirety of BHI’s lawsuit.

Won a major Second Circuit victory for Relevent Sports Group, LLC, a sports promoter that organizes soccer matches in the U.S. involving professional teams from non-U.S. leagues. A unanimous Second Circuit panel—repeatedly citing and quoting Winston’s briefs and oral argument—vacated the district court’s decision and revived Relevent’s antitrust suit against FIFA and the U.S. Soccer Federation, challenging a FIFA rule prohibiting official-season professional soccer games from being played outside a team or league’s FIFA-designated country. Am Law recognized the March 2023 win with a “LOTW” Runner-Up nod. With DOJ and Solicitor General support, we defeated Supreme Court review, leading to settlements with both defendants and paving the way for U.S.-venued foreign-league games.

Winston Wins Dismissal of False Advertising Claims Against Birdseed Manufacturer
Plaintiffs filed suit in the Northern District of California, claiming a publicly traded market leader in the pet and garden industries misled consumers with its "Wild Bird Seed" and "Wild Bird Feed" products because they contained milo, which wild birds supposedly dislike. Winston argued the products had ingredients birds eat, birds can eat milo, and plaintiffs got what they paid for. On January 16, 2025, the court dismissed the class action, allowing an amendment, but plaintiffs voluntarily dropped it instead.

What Is Executive Compensation?
The term executive compensation refers to the financial payments and non-financial benefits provided to the upper level management within a business or organization. Employees who receive this type of compensation are generally presidents or vice-presidents, chief executive, financial, operating, legal, and other C-Suite executives. An executive compensation package is a group of benefits that could include stock awards, severance protection, deferred compensation, and retirement plans. SEC regulations require public companies to disclose the amount their executives are earning, plus how this amount is calculated. Some states also have executive compensation laws.

A class action is a procedural device that allows one or more persons, usually plaintiffs (though federal and state procedural rules also authorize defendant classes) to file suit on behalf of a group of similarly situated persons. Federal law defines a class action as “any civil action filed under Rule 23 of the Federal Rules of Civil Procedure or similar State statute or rule of judicial procedure authorizing an action to be brought by 1 or more representative persons as a class action.” 28 U.S.C. § 1332(d)(1)(B), (d)(8).
