Banks Operating in Florida Should Be Aware of New Florida Rule Before Closing Customer Accounts
On May 2, 2024, Florida Governor DeSantis signed Florida House Bill 989 (HB 989) into law. Among other things, HB 989 amends section 655.0323 of the Florida Statutes, titled “Unsafe and unsound practices,” which the Florida Legislature adopted in 2023 pursuant to Florida House Bill 3 (HB 3).[1] The provisions of HB 989 will become effective on July 1, 2024.

What Is the Better Business Bureau (BBB)?
The Better Business Bureau (BBB) is a private organization that provides the public with information on businesses and charities. It also handles consumer complaints about firms. The nonprofit bureau has developed a rating system for businesses based on a scale of A+ to F. Each rating is determined according to specific criteria relating to a company’s ethics and performance. The BBB offers guidance to companies on proper practices. Firms that follow these policies and pay annual dues can become accredited through the bureau. To obtain accreditation, a business must be operate with transparency, be appropriately licensed, adhere to BBB advertising codes, and have no unresolved consumer complaints.

Environmental criteria consider how a company protects the environment, including corporate policies addressing climate change. Social criteria examine how a company values and supports relationships with employees, suppliers, customers, and its local communities. Governance deals with, among other things, a company’s leadership, executive compensation, and shareholder rights.
