Won a major Second Circuit victory for Relevent Sports Group, LLC, a sports promoter that organizes soccer matches in the U.S. involving professional teams from non-U.S. leagues. A unanimous Second Circuit panel—repeatedly citing and quoting Winston’s briefs and oral argument—vacated the district court’s decision and revived Relevent’s antitrust suit against FIFA and the U.S. Soccer Federation, challenging a FIFA rule prohibiting official-season professional soccer games from being played outside a team or league’s FIFA-designated country. Am Law recognized the March 2023 win with a “LOTW” Runner-Up nod. With DOJ and Solicitor General support, we defeated Supreme Court review, leading to settlements with both defendants and paving the way for U.S.-venued foreign-league games.

American Multinational Hedge Fund and Financial Services Company Trademark Counseling
Winston does significant brand enforcement work for an American multinational hedge fund and financial services company, including trademark opposition and cancellation proceedings, UDRP and related domain name proceedings as well as other enforcement work on a global basis. We represent the company in its global trademark portfolio management and in domain registry matters and in connection with IP licensing. We also advise on other IP-related matters, including open-source counseling.

Supreme Court of Illinois Unanimously Affirmed Win for Atlantic Richfield
Secured a long-fought victory for Atlantic Richfield Company (ARCO) in a case dealing with hypothetical costs associated with state-required lead testing. The claims centered on the plaintiffs’ need to have their children screened for potential lead poisoning, but the plaintiffs did not allege any actual physical injury to their children. Nor did they pay for the lead screening; Medicaid did. The case was repeatedly revived by the Illinois Appellate Court until the Supreme Court of Illinois, unanimously affirmed the trial court’s ruling in favor of our client.

Law Glossary
TCPA is the abbreviation for the Telephone Consumer Protection Act of 1991. The law restricts telemarketing certain phone calls, text messages, and facsimiles. It also places restrictions on the use of automatic dialing systems and artificial or prerecorded voice messages. Collections’ actions by phone are also regulated under the act. Consumers may file complaints with Federal Communications Commission (FCC) when TCPA is violated. Since TCPA law governs consumer rights, lawsuits may also be filed by consumers who suffer violations.
Law Glossary
The field of telemarketing law covers U.S. legislation, federal agency regulations, and state statutes that determine how telemarketers can contact consumers and businesses by phone or text message. The Telephone Consumer Protection Act (TCPA) and Telemarketing Sales Rule (TSR) restrict telemarketing calls, automatic phone dialing, and prerecorded messages. TCPA also requires telemarketers to obtain consumers’ signed written consent before robocalling or robotexting them.
