Signed Arbitration Agreements with Class Action Waivers Pushes Wage and Hour Case to Early Mediation
Winston represented a large bank-owned retail mortgage originator and loan servicer in a wage and hour class action in which plaintiffs asserted class claims for failure to pay overtime, to provide meal and rest breaks, and other related alleged violations of the California Labor Code. Winston used the fact that many of the employees in the putative class had signed arbitration agreements with class action waivers to push the case to an early mediation, which resulted in a favorable resolution for our client.
