Private Credit Is Booming; Banks Want Back In
Once satisfied with their dominant position in commercial lending from the middle market through the large cap, public syndicated market, banks have suffered significant erosion of market share at the hands of private credit (i.e., “direct lending”) competitors. With a wide range of firms leading the “golden age” of private credit, banks increasingly want back in and are employing a variety of strategies to get there. With the addressable U.S. market for private credit nearing $2.0 trillion (still a fraction of the public market), banks are ever more eager to participate in private credit’s one-stop lending solution that is one of the fastest growing businesses on Wall Street. Over the past several years, high-profile partnerships and other collaborations among banks and private credit firms have been announced at a brisk pace. Such activity is likely to continue.

What Is Consumer Tracking Law?
Companies analyze consumers’ online activities by tracking their behavior. There is no specific consumer tracking law in the U.S. at the federal level; however, Federal Trade Commission Behavioral Advertising Principles recommend that websites disclose data collection policies that are used to create targeted marketing. The legal areas of consumer tracking deal with how websites, analytics companies, advertisers, plug-in providers, and other online services track users via first- and third-party cookies, as well as other methods. Consumers do have the option to use the Do Not Track (DNT) settings available in web browser settings, though companies do not have to legally follow DNT requests. If a company adopts a policy of honoring Do Not Track requests, it is legally required to follow that policy. The FTC also has guidelines for the collection of user location data by mobile apps when the apps are not in use.

What Is Privacy Compliance Law?
The area of privacy compliance law addresses how organizations meet legal and regulatory requirements for collecting, processing, or maintaining personal information. Data privacy breaches can lead to regulatory investigations and fines. When privacy is compromised, consumers or employees may respond with civil lawsuits. It is recommended, but not required by a federal law, that companies create and post privacy policies on websites and mobile apps. Once posted, companies must follow these policies or face scrutiny by the Federal Trade Commission. (California and Delaware state law does require privacy policies to be posted on websites and mobile applications, if the site collects personally identifiable information).
