Winston & Strawn partner Bobby Malhotra was quoted in a Bloomberg Law article discussing the OpenAI Inc. copyright lawsuit and legal debate over how to balance a court’s need for information against protecting individuals’ personal data. OpenAI has been challenging a court order to preserve its ChatGPT outputs in a precedent-setting copyright case, claiming the order threatens hundreds of millions of its users’ privacy rights. The first of its kind case will show how courts will weigh legal questions against protecting the privacy of large amounts of personal information in AI-related litigation.

Oregon Enacts SB 951, Restricting PE-Backed MSOs in Physician Practice Transactions
On June 9, 2025, Oregon enacted Senate Bill 951 (SB 951), a sweeping new law significantly limiting how management services organizations (MSOs)—including those backed by private-equity firms—may engage with physician practices. The legislation targets traditional “friendly provider” models by restricting ownership and operational control of professional medical entities and voiding restrictive covenants. Investors must now reassess Oregon-based physician practice investments to ensure compliance by 2026 (for new MSOs) and 2029 (for existing ones). It’s noteworthy that this law will coexist with Oregon’s complicated health care transactions notice law, a law that requires a thorough review of certain health care transactions.

What Is Workplace Privacy Law?
Workplace privacy law involves the legal questions that arise as employers monitor their employees’ activities. Companies may monitor through visual surveillance, such as cameras, and electronic surveillance, and email audits. Businesses monitor to protect confidential information and to help prevent behavioral violations. Employers have broad rights to copy and monitor email sent over company electronic systems and to view these emails as business property. Emails can be monitored based on a number of business principles, including to encourage productivity and discourage illegal activity. Regarding surveillance, employees are allowed reasonable expectations of privacy in areas such as bathrooms. Legal issues may arise when hidden cameras are placed in work areas where employees are not aware of the surveillance.

What Is Tracking and Monitoring Law?
Tracking and monitoring law is related to the rights of individuals and often addressed through state legislation. Tracking law looks at when and how individuals can be tracked through GPS devices and location services. Employers have the right to track company vehicles through GPS devices but cannot track an employee’s vehicle in many states without employee consent. (A written policy on tracking and monitoring may be required, with the policies stating a business purpose for the activities.) Tracking apps on mobile phones can continue to broadcast an employee’s location even after work hours. That is why companies must ensure they are satisfying employees’ expectations of privacy.
