The PTAB’s Institution Grant Rate Has Dropped After Announcement of the New PTAB Discretionary Denial Guidance and Briefing Procedure

Acting Patent Trial and Appeal Board (PTAB) Director Coke Stewart was sworn in on January 20, 2025, rescinded the prior Director’s discretionary denial guidance on February 28, 2025, and implemented new guidance and a new discretionary denial briefing schedule between March 24 and 26, 2025. See here. Decisions on requests submitted under the new process are anticipated to start rolling out soon. The Patent Office reported receiving more than 40 requests for discretionary denial under the new process as of April 17. The process gives petitioners one month to respond to the requests and the PTAB another month to provide a decision.  ...Read more

USPTO Director Review Insights and PTAB Policy Shifts: Early 2025

The U.S. Patent and Trademark Office (USPTO) granted seven requests for Director Review in the first quarter of 2025 and reported denying fifty-three requests during this same period. By comparison, the USPTO granted four requests for Director review in the last quarter of 2024 and reported denying 38 requests. The latest Director Review opinion suggests a policy shift towards more discretionary denials of IPR petitions, even with a Sotera stipulation.

Winston and Cisco Collaborate to Support Migrants in NYC

As part of the firm’s client partnering pro bono initiative, Winston attorneys and members of Cisco’s legal department recently teamed up to help 12 migrant families file for asylum. This pro bono collaboration continues Winston’s ongoing participation in New York City’s Asylum Application Help Center, which Mayor Eric Adams launched in response to the migrant crisis in July. More than 100,000 migrants and asylum seekers have arrived in NYC since the beginning of the year.
