Winston Wins Ninth Circuit Reversal and Class Certification in Swimmers’ Antitrust Case, Securing a Global-Impact Settlement with World Aquatics

Winston represents a class of professional swimmers alleging World Aquatics (WA) violated antitrust laws by blocking their participation in the competing  International Swimming League. After WA won summary judgment, Winston successfully appealed, arguing the court applied improper antitrust standards and wrongly denied certification of a damages class. In September 2024, the Ninth Circuit reversed both rulings, reviving all claims and issuing a landmark ruling on the possible application of the per se rule or quick look review to sports-associations rules. California Limits Contractor Retention to Five Percent

Starting in 2026, California will cap retention in private construction contracts at 5%, matching public works standards. The rule excludes non-mixed-use residential projects under four stories and applies across all contractor-subcontractor levels. Lower retention rates for direct contractors will extend to subcontractors. Advocates say that the cap will ease financial strain, especially for smaller firms. Owners may respond with stricter bonding requirements, potentially raising construction costs due to reduced protection against non-performance.

What Is Removal Law?

Removal is a procedural mechanism through which a case filed in state court may be transferred to federal court upon the request of one or more parties. Actions filed in state court over which a federal court would have original jurisdiction may be transferred—or removed—to federal court under the removal statute, 28 U.S.C. § 1441. Generally speaking, removal is possible if (1) the plaintiff(s) and defendant(s) are citizens of different states and the case places more than $75,000 in controversy (so-called “diversity” jurisdiction), or (2) the case turns on issues of federal law (so-called “federal question” jurisdiction). In many cases, defendants prefer to be in federal court, and so defendants often analyze early in the case whether removal is possible. ...Read more

What Is Children’s Privacy Law?

An important children’s privacy law in the U.S. is the Children’s Online Privacy Protection Act (COPPA). COPPA requires the Federal Trade Commission to issue and enforce regulations concerning the online privacy of those under age 13. The Commission’s first COPPA Rule took effect in 2000, and an amended Rule took effect in 2013. The primary goal of COPPA is to place parents in control over personal information collected from their children online. Its Rule applies to commercial websites, online services, and mobile apps that collect, use, or disclose children’s personal information. The Act applies to websites designed for children’s use but can also apply to general audience sites. Additionally, the Family Educational Rights and Privacy Act (FERPA) is a federal law that prevents the sharing of personal student data and educational records with third parties without parental consent.
