Winston represents a class of professional swimmers alleging World Aquatics (WA) violated antitrust laws by blocking their participation in the competing International Swimming League. After WA won summary judgment, Winston successfully appealed, arguing the court applied improper antitrust standards and wrongly denied certification of a damages class. In September 2024, the Ninth Circuit reversed both rulings, reviving all claims and issuing a landmark ruling on the possible application of the per se rule or quick look review to sports-associations rules. Am Law awarded Winston “Litigator of the Week” Runner-Up recognition for the win. In November 2024, the Ninth Circuit denied rehearing. In April 2025, the district court certified a damages class.

Represent Norman W. Fries, Inc. d/b/a Claxton Poultry Farms in a series of 15+ antitrust class actions consolidated in the Northern District of Illinois and brought by plaintiffs who allege that Claxton and the nation’s other largest poultry producers conspired to fix the price of broiler chickens in a scheme from 2008 to 2016 that raised the price for broiler chickens by artificially reducing supply.

Winston Blunts Earnout Payment
Following a bench trial in Fall 2024, a New York trial court ruled in March 2025 that Cresco Labs, Inc. was not required to pay a US$45M earnout under a merger agreement. The court found that Cresco did not receive “commercially reasonable access” to New York’s adult-use cannabis market, which was supposed to be subject only to a non-competitive application or approval process. Adopting Cresco’s arguments, the court determined that only the Office of Cannabis Management and Cannabis Control Board could decide when and how applicants access the adult-use market. The court agreed that regulators required Cresco to pay a significant one-time fee, prioritized other applicants, and had broad discretion over approvals. This win supports claims that New York’s adult-use program lacks details and clear entry paths, frustrating industry leaders’ efforts to develop a robust adult-use market.

DOJ Continues False Claims Act Enforcement of PPP Loans Into 2026
Even though five years have passed since Congress enacted the Paycheck Protection Program (PPP) as an emergency response to the COVID‑19 pandemic, enforcement activity relating to PPP loans remains an active component of the federal government’s civil fraud agenda and—with the statute of limitations not expiring for another roughly five years—all indications are that it will continue to be an enforcement priority for the foreseeable future.

Andrew Hinkes Discusses Prediction Market Litigation and CFTC Authority with Bloomberg Law
Winston & Strawn partner Andrew Hinkes was quoted in a Bloomberg Law article discussing the regulation of prediction markets and the scope of the Commodity Futures Trading Commission’s authority. States argue that event contracts, which let traders wager on binary outcomes, are essentially gambling and subject to state gaming regulation, while the platforms contend they are swaps and thus fall under the CFTC’s federal “swap” rules. The CFTC filed an amicus brief in North American Derivatives Exchange Inc., v. The State of Nevada, an action currently pending In the United States Court of Appeals for the Ninth Circuit, arguing that event contracts are subject to the Commodities Exchange Act, and thus that state law on the same topic is pre-empted.
