Brooke has significant state and federal litigation experience at both the trial and appellate court levels. She routinely litigates complex commercial cases for a wide variety of clients across multiple different industries, including major financial institutions, Fortune 500 companies, healthcare companies, real estate developers, and high-net-worth individuals. As a former New York litigator, Brooke brings a broad national perspective to any case, leveraging her diverse experience to solve clients' problems.

Brooke represents clients in a broad range of litigation matters, including shareholder derivative and fiduciary duty litigation, breach of contract suits, securities litigation, mass torts litigation, real estate litigation, and patent litigation. She routinely litigates complex commercial cases that cover numerous jurisdictional challenges in courts across the country.

Brooke wins victories for her clients with creative and persuasive arguments in written briefs and through oral advocacy. She has experience arguing in federal court, including winning a motion that resulted in a favorable written order quoting her. And when a ruling does not result in the most favorable outcome for her clients, she has the background and experience to appeal those rulings to the highest state or federal court. She will also often advise clients on how an appellate court may consider a case’s merits on appeal.

She also has experience in white-collar criminal defense and government and internal investigations. In these matters, she represents individuals and companies with a critical eye towards potential litigation. She has experience addressing all types of subpoenas—civil, criminal, and administrative. She has successfully prevented clients from turning over sensitive information, including a financial data company from producing highly confidential and business sensitive information to the government in a criminal case to which it was not a party.

Prior to joining Winston, Brooke was a judicial law clerk to the Honorable Paul B. Matey on the United States Court of Appeals for the Third Circuit. Between college and law school, Brooke worked in public policy in Washington, D.C.

  • Successfully prevented a temporary restraining order and permanent injunction against a company for alleged violations of employees’ noncompetition and non-solicitation agreements
  • Successful briefed and argued motion to compel discovery documents before federal court judge in the Southern District of New York, resulting in favorable written order that quoted her
  • Represented clients in federal and state court appeals, including the New York Court of Appeals and the United States Court of Appeals for the Eleventh Circuit
  • Represented a corporate officer in parallel criminal and civil insider trading investigations and a nonparty in a motion to quash a Rule 17(c) criminal subpoena in underlying securities fraud case
  • Represented pro bono a Tibetan monk seeking asylum based on religious persecution

Brooke earned a J.D. from the University of Virginia School of Law, where she was assistant managing editor for the Journal of Law & Politics and selected as a Dillard Fellow to provide teaching assistance to the first-year legal research and writing class. She graduated with a B.A, magna cum laude and Phi Beta Kappa, from the University of California, Los Angeles. Between college and law school, Brooke worked in public policy in Washington, D.C.
