Louis is a seasoned patent litigator with extensive experience representing both patent owners and accused infringers before district courts and the International Trade Commission. His 17 ITC investigations since 2010 rank him among the most experienced ITC litigators, especially among those based outside of Washington, D.C. He holds a B.S. in electrical engineering.

Louis' engineering and communication skills place his clients in their best position to win, which has been proven time and again in successful outcomes at the ITC. For example, through a detailed cross-examination at trial, Louis was able to go through several dozen lines of source code of a prior art product and extract an admission from a hostile technical witness that the product lacked key functionality, which contradicted the defendant’s expert witness. This key admission helped to defend his client’s patent from a validity challenge. Notably, extracting this admission would have been impossible without being able to read and understand the source code as well as explain it to non-engineers.

Louis has also litigated in all the other major patent litigation venues including the Eastern District of Texas, Northern District of California, District of Delaware, and Federal Circuit. He has experience with all phases of litigation from pre-filing investigation through PTAB IPR proceedings, Markman hearings, trial, and appeal. He has experience with a wide variety of technologies including mobile applications, check processing, interactive program guides, smartphones, distributed computing, networking, wireless communication standards such as LTE, CDMA, WCDMA, 802.11, and 802.3, video games, graphics, S3TC and PVRTC texture compression, x86 and ARM processor instruction sets, CPU and GPU architecture, wafer fabrication, cryptography, industrial control systems, supply chain management, and automobile wiper blades.

Key Matters

  • Defended several video game distributors against patent infringement claims related to online multi-player functionality. Obtained favorable summary judgment rulings on several asserted patents.
  • Defended a cable provider against patent infringement claims in the International Trade Commission. After completion of trial, all asserted claims have been found non-infringed and/or invalid.
  • Obtained summary judgment for a GPU manufacturer in a patent ownership dispute in the U.S. District Court. The opposition had claimed to own several of GPU manufacturer’s patents. After obtaining partial summary judgment in GPU manufacturer’s favor, the parties reached a settlement agreement in GPU manufacturer’s favor. Louis was the technical lead in this case, gathering much of the technical evidence and taking several important depositions. 11-1298-LPS (D. Del.)
  • Defended an auto parts manufacturer against patent infringement claims in the International Trade Commission. Shortly after Winston submitted the Markman briefs (written by Louis) and took the deposition of the opposing expert, the parties reached a favorable settlement. 337-TA-928.
  • In a dispute instigated by a competitor, Louis defended a major memory company against the competitor’s infringement claims and asserted patent infringement claims against the competitor in two matters before the International Trade Commission. After completing both trials, in both of which Louis cross-examined witnesses, but prior to an initial determination in either investigation, the parties reached a settlement in our client’s favor. 337-TA-893 and 337-TA-909.
  • Defended a major electronics maker against infringement claims in the International Trade Commission. Obtained a favorable settlement before trial. 337-TA-885.
  • Defended a major manufacturer of mobile telephone base stations against infringement claims in the International Trade Commission. Rather than respond to a motion for sanctions based on the opposition’s lack of a good faith basis for asserting infringement, the opposition withdrew its complaint before trial. Louis was primarily responsible for gathering the invalidity evidence and Winston was prepared to present several strong theories of invalidity at trial. 337-TA-871.
  • Defended a major mobile phone manufacturer against infringement in the International Trade Commission. Obtained a favorable settlement before trial. 337-TA-839.
  • Represented a GPU manufacturer in a second suit asserting patent infringement against a major computer and mobile phone manufacturer in the International Trade Commission. Obtained a favorable settlement before trial. 337-TA-813.
  • Represented a microprocessor company in asserting infringement against major computer and mobile phone manufacturer who also designs its microprocessors for its own products in the International Trade Commission. After trial, in which Louis cross-examined a fact witness and took the direct examination of an expert witness, obtained a favorable settlement after trial. 337-TA-812.
  • Represented a GPU manufacturer in asserting patent infringement against a major computer and mobile phone manufacturer in the International Trade Commission. After trial in which Louis cross-examined five technical witnesses, the GPU manufacturer obtained an initial determination finding infringement and recommending exclusion of Apple products. Jurisdictional ruling was appealed to Federal Circuit and oral argument was imminent when the parties reached a settlement. 337-TA-724.
