Winston & Strawn lawyers Laurens Wilkes, Gus Membiela, and Madison Haueisen were featured in the Mealey’s International Arbitration Report featuring commentary from international arbitration leaders discussing the use of an AI arbitrator for construction arbitrations. In their commentary Laurens, Gus, and Madison provide their thoughts on the legal, ethical, and practical implications of the American Arbitration Association’s International Centre for Dispute Resolution (AAA-ICDR) announcement.
They explain that the AAA-ICDR’s AI Arbitrator appears potentially well-equipped to increase efficiency and help human arbitrators “call balls and strikes” in documents-only construction cases. They note that as the task shifts to credibility disputes and novel legal questions, including questions over good faith and reasonableness, and the AI Arbitrator’s role expands, informed consent, clear disclosures, robust attorney oversight, and other ethical guardrails will be essential to preserving fairness and arbitral legitimacy.
