Michael Kimberly Recognized in Litigator of the Week Column

Winston & Strawn partner Michael Kimberly was recognized for his notable win in The Am Law Litigation Daily’s Litigator of the Week column on August 1, 2025. 

Partner Michael Kimberly was recognized among the lawyers representing a group of pharmacy benefits managers (PBMs) and an industry trade association in a challenge to an Arkansas law that would have revoked PBMs’ licenses to own or operate pharmacies in the state. Michael represented the Pharmaceutical Care Management Association and Navitus. U.S. District Judge Brian Miller in Little Rock this week granted a motion for a preliminary injunction blocking the law. The judge found the plaintiffs had shown that the law likely violates the Dormant Commerce Clause and is preempted by the federal TRICARE program aimed at providing health insurance plans to members of the U.S. military.
