eDiscovery & Information Management Practice Chair John Rosenthal spoke at PLI’s Electronic Discovery Institute 2016: What Corporate and Outside Counsel Need to Know on September 19. This seminar was designed to provide counsel with the understanding necessary to advise clients on state, federal, and international e-discovery strategic and technology issues.

The demands and costs of e-discovery in litigation continue to grow. Nearly every case now involves some sort of e-discovery, and it is essential to know how to effectively and fairly handle the many issues that can arise. This seminar provided an inside look at the current state of e-discovery, gave tips for avoiding pitfalls litigants have encountered in the years since the passage of the federal rules, and discussed important ethical issues in light of court decisions imposing discovery sanctions and outlining the duties of outside and in-house counsel.

Mr. Rosenthal presented “Data Privacy and E-Discovery.” This session addressed:

  • Domestic issues – impact of federal and state privacy and data transfer laws and regulations
  • Cross-border issues – conflict between U.S. discovery obligations and foreign data privacy laws
  • Possession, custody and control – where is the data and who controls it?
  • Practical implications of the Privacy Shield
