John Rosenthal Comments on E-Discovery Opinion

Litigation partner John Rosenthal, chairman of Winston & Strawn's e-discovery and electronic information practice group, was quoted in Law360's "Sanctions Ruling Offers Guidelines On E-Discovery," regarding Magistrate Judge Paul W. Grimm's ruling in Victor Stanley Inc. v. Creative Pipe Inc. et al.
Grimm, of the U.S. District Court for the District of Maryland, issued an 89-page opinion that has been regarded as one of the most comprehensive looks at preservation and spoliation of e-discovery. The opinion provides a framework for attorneys and judges unfamiliar with the concept of e-discovery spoliation and preservation case law.
"He distills it and synthesizes it for the non-e-discovery lawyer in a way that makes it much easier for them to understand what their obligations are and the framework for analyzing their failure to comply with those obligations," said Mr. Rosenthal.
Mr. Rosenthal, based in the firm's Washington, D.C. office, counsels a wide variety of companies on record retention programs, compliance with electronic discovery, and implementing programs to reduce risk associated with the generation and retention of electronic records.
