David Enzminger Featured in the Daily Journal’s “Top 100 Lawyers in California”

David Enzminger, managing partner of Winston & Strawn's Silicon Valley office, was listed among the Daily Journal's "Top 100 Lawyers in California," published September 11, 2013.

Mr. Enzminger, who focuses his practice on technology litigation, emphasizing patent, trade secret, trademark, and antitrust matters, scored a major win last December for his defense of Belkin International against Fujitsu Ltd. in a patent infringement claim, which was named one of the Top Verdicts of 2012. As lead counsel, Mr. Enzminger successfully argued that the patent was invalid because the claimed invention was both obvious and anticipated over pre-existing technology. According to Mr. Enzminger, had Fujitsu prevailed, every manufacturer who used a plug-in WiFi card could have been exposed to liability.

"The big strategy lesson to be learned is don't overreach on damages," Mr. Enzminger said. "Fujitsu's settlement demands simply were not in the realm of possibility. That forced us to take the case to trial. If they'd asked for less, there probably would have been a settlement with less money and energy spent going to court."

Mr. Enzminger was also named one of this year's "Top 75 IP Litigators" by the Daily Journal.
