Partner Brian Ferguson moderated a panel at The Sedona Conference on AI and the Law Part 2: AI and IP Law, which took place in Reston, Virginia June 20 to June 21. The panel discussed the challenges AI presents to the patent law system and if contractual agreements with AI providers or employees use of AI to innovate could create risks of losing patent rights.

After a successful Part 1 of this series in April 2024, Part 2 focused on substantive Intellectual Property issues, with dialogue leaders tackling:

  • AI in the invention and patent prosecution processes,
  • AI-related issues in patent infringement and validity actions,
  • Trade secret challenges presented by AI, and
  • AI's challenges to copyright law, with a review of recent case law.

The conference concluded with a panel of regulators, judges, and a key federal legislator discussing the future of AI regulation and governance.
