Bobby Malhotra Discusses Challenges Facing eDiscovery in a Q&A With Legaltech News

In a Q&A with Legaltech News, Winston & Strawn Partner Bobby Malhotra spoke about his recent move to the firm, as well as the biggest challenges facing ediscovery today. 

Bobby discussed topics including his use of AI tools to solve legal challenges, concerns and risks associated with collaboration apps, and challenges stemming from new communication apps, increased use of cloud computing applications, and the proliferation of these new technologies. 

"First and foremost, is the management of legal hold preservation and production of dynamic and ephemeral data sources. You know, we talked about today’s collaboration apps and mobile devices, and they’re generating dynamic and constantly changing data from minute to minute and day to day," Bobby said. "So it can be challenging to understand what is potentially relevant or [where] responsive data resides, manage the litigation hold process and preserve this type of data with traditional ediscovery methods. So it is going to require some outside-of-the-box thinking depending on the challenges you’re facing."
