The cost of document review can be the highest expense associated with any litigation. The traditional model of using partner-track associates to conduct the review is no longer a feasible or cost-effective strategy. Use of lower-cost reviewers through staffing companies or outsourced providers has become an alternative for many litigants. That solution, however, is not always the best one depending upon the particular case/electronically stored information ("ESI") at issue. In addition, quality concerns about outsourced reviews persist, unless they are carefully managed and supervised. An optimal approach to document review is to use a combination of people, process and technology to dramatically lower the cost of electronic document review.
Winston & Strawn attorney John Rosenthal, chair of the firm's eDiscovery Practice Group led a practical, interactive presentation that provided the latest strategies for conducting a modern document review.
The discussion focused on:
- Effective strategies for reducing the cost of an electronic document review;
- Use of second generation search technologies to both filter document sets and more efficiently organize the materials for review, including concepting, clustering, threading and near-duping technologies;
- Implementing best practices in the review process to ensure a high degree of precision and recall;
- Effective strategies for handling privilege documents; and
- Use of lower-cost reviewers.
