Judge Albright issued two amended standing orders, which are now published on the Western District of Texas website.

Judge Albright announced his latest changes to his Order Governing Procedures in the Waco Division of the Western District of Texas, including a new rule regarding transfer discovery and new staged (versus simultaneous) Markman briefing.

Today Judge Albright again modified his Order Governing Proceedings. Judge Albright maintained his order regarding transfer motions (motions must be filed within 2 weeks of the CMC) and extended the deadline for amending the complaint by 4 weeks to 16 weeks after the Markman hearing.

Judge Albright will soon be posting and using a revised Order Governing Proceedings (OGP) with changes related to discovery practice and issues related to claim construction.

In a one-paragraph docket-text order, the court denied defendant’s early case Rule 12 motion to dismiss due to alleged patent ineligibility under Alice and Section 101.

In his ongoing effort to provide more transparency into his decision-making, Judge Albright opened the virtual doors to his “courtroom” on Wednesday (April 22, 2020) for the Markman hearing in Slyce Acquisition Inc. v. Syte – Visual Conception Ltd. et al., WDTX-6:19-cv-00257.
