She has been a Certified Information Privacy Professional /US for more than 7 years, and she is also a Certified Computer Examiner and forensic expert.

Outside her practice, Sheryl serves on the Expert Advisory Board for HireVue, an AI software company and she is actively involved in The Sedona Conference Working Group 11: Data Security and Privacy, whose mission is to develop best practices in privacy and data security.

She uses the investigation skills she honed as a Federal prosecutor and her computer forensic skills to investigate data security matters, digging to find the truth and to uncover and address theft of confidential corporate data.

Trade Secret and Data Privacy Litigation: A former Assistant U.S. Attorney, experienced litigator, and Forensic Computer Expert, Sheryl has built in-depth experience prosecuting and defending trade secret cases, Computer Fraud and Abuse Act cases, Data Privacy class action litigation, and Data Breach cases. She has also been called in to complex commercial and IP litigations to handle specialized data issues, including leading the forensic expert matters and spoliation. Her cutting edge knowledge of data and data forensics provides a decisive competitive advantage in data security litigation.

Cyber & Data Security Investigations and Response: Sheryl has over twelve years of experience leading the response to cyberattacks and data security investigations. She is known as a highly responsive and effective leader, whose quiet strength has enabled her to successfully lead teams responding to significant breach matters, including international data breaches, high stakes data security matters, ransomware attacks, data loss, and internal data theft. Sheryl draws on her years of experience and data security expertise to balance supporting the ongoing business operations while effectively managing the forensic investigation and remediation, always aware of the potential risk to her clients’ finances and reputation.

Experience

  • Suncoast Post-Tension, Ltd. v. Peter Scoppa, The Sterling Engineering Group of Companies, PT USA, Inc., and Sandeep Patel. After a five-day trial, a Houston federal jury awarded $24.5 million in a copyright and trade secret theft case in favor of Winston client Suncoast Post-Tension, Ltd., the nation's largest supplier of systems that strengthen concrete for high-rise buildings and other structures. The Winston team proved that a former employee and others on two continents conspired to steal Suncoast's proprietary information and start a competing company. Sheryl's discovery of key evidence was crucial in the jury's ruling. After trial, the district court awarded attorneys' fees and pre-judgment interest, bringing the final verdict to almost $28 million.
  • INROCK Drilling Systems, Inc. et al. v. Darrell Klesel, et al. Served as counsel for INROCK Drilling Systems, Inc. in trade secret litigation in the 215th Judicial District Court of Harris County, Texas against six former employees and two corporate defendants involving products and services in the horizontal directional drilling industry. Successfully obtained a temporary restraining order, expedited discovery, and temporary injunction against defendants. The case was quickly developed and litigated, and was settled favorably against all defendants within three months
  • Successful trial against multi-plaintiff products liability claim involving plastic resin chairs.
  • Successful trial resulting in $7.5 million verdict in breach of contract case for chemical manufacturer.
  • Successful trial defending against Estate of Elvis Presley's claim of trademark infringement.
  • Successfully defended company against a $12 million shareholder's derivative claim in arbitration.
  • Defended against a $15 million products liability claim arising out of petrochemical explosion blamed on a defective valve. After winning partial summary judgment, case settled.

Sheryl Falk has spent the last decade focusing on digital evidence and emerging technology issues. In addition to her extensive commercial litigation experience, Ms. Falk is certified in computer forensics and has in-depth technical knowledge and experience with data security and privacy matters. This background provides her clients with the skills required to handle technology challenges, including data loss prevention, data breach response, and privacy counseling. Ms. Falk assists clients with investigating and responding to data breaches; developing privacy programs and trade secret protocols; ensuring compliance with both national and international privacy programs, delivering employee training related to data loss, prevention and privacy issues, conducting internal investigations of theft of trade secrets, litigating data breach and trade secret cases, handling digital evidence issues, including early case assessment and spoliation, and consulting on international data transfer matters.

Experience

  • Suncoast Post-Tension, Ltd. v. Peter Scoppa, The Sterling Engineering Group of Companies, PT USA, Inc., and Sandeep Patel. After a five-day trial, a Houston federal jury awarded $24.5 million in a copyright and trade secret theft case in favor of Winston client Suncoast Post-Tension, Ltd., the nation's largest supplier of systems that strengthen concrete for high-rise buildings and other structures. The Winston team proved that a former employee and others on two continents conspired to steal Suncoast's proprietary information and start a competing company. Sheryl's discovery of key evidence was crucial in the jury's ruling. After trial, the district court awarded attorneys' fees and pre-judgment interest, bringing the final verdict to almost $28 million.
  • INROCK Drilling Systems, Inc. et al. v. Darrell Klesel, et al. Served as counsel for INROCK Drilling Systems, Inc. in trade secret litigation in the 215th Judicial District Court of Harris County, Texas against six former employees and two corporate defendants involving products and services in the horizontal directional drilling industry. Successfully obtained a temporary restraining order, expedited discovery, and temporary injunction against defendants. The case was quickly developed and litigated, and was settled favorably against all defendants within three months
  • Successful trial against multi-plaintiff products liability claim involving plastic resin chairs.
  • Successful trial resulting in $7.5 million verdict in breach of contract case for chemical manufacturer.
  • Successful trial defending against Estate of Elvis Presley's claim of trademark infringement.
  • Successfully defended company against a $12 million shareholder's derivative claim in arbitration.
  • Defended against a $15 million products liability claim arising out of petrochemical explosion blamed on a defective valve. After winning partial summary judgment, case settled.
