Winston & Strawn hosted a virtual discussion of the key challenges that Japanese companies face when investing into the United States. Moderated by Jeffrey Kessler, Co-Executive Chairman of the firm and Co-Chair of Winston’s Antitrust/Competition Practice, this program explored not only the myriad obstacles to be taken into consideration, but also strategies that can be implemented to successfully close the deals.
Partner Tyler McGaughey shared perspectives on how to navigate the process of transaction reviews conducted by the Committee on Foreign Investment in the United States (CFIUS). Tyler advises corporate clients on cross-border transactions that fall within the jurisdiction of CFIUS drawing upon his recent experience as a senior official at the U.S. Department of the Treasury, where he was responsible for managing the day-to-day operations of Treasury’s CFIUS team.
Antitrust/Competition Partners Eva Cole and Heather Lamberg presented a practical introduction to the merger review process in the United States, with a focus on antitrust merger review trends and diligence issues, while providing best practice strategies to maximize the likelihood of a successful outcome while minimizing the burden on the company.
