Landmark Antitrust Class Action Settlement for College Athletes Receives Final Approval
On June 6, 2025, the landmark antitrust class action settlement, secured by Winston & Strawn and Hagens Berman on behalf of college athletes, with the NCAA, Big Ten, SEC, Pac-12, Big 12 and ACC was approved by U.S. District Judge Claudia Wilken, resolving three antitrust lawsuits that challenged NCAA limits on compensation and benefits that college athletes can receive for their athletic services and their names, images, and likenesses (NIL).

Last month, the Texas Senate passed Senate Bill 30, joining a growing group of state legislatures seeking to limit plaintiffs’ tort recovery. According to the bill’s proponents, the legislation is intended to limit so-called “nuclear verdicts,” generally understood to refer to verdicts in excess of $10 million.

Michael Kimberly Joins Winston & Strawn in Washington, D.C.
Winston & Strawn recently announced the addition of Michael Kimberly to the firm’s Washington, D.C. office where he joins as co-chair of the Appellate & Critical Motions Practice. Michael brings a remarkable record of success, having argued nine cases before the U.S. Supreme Court and delivered more than 40 appellate arguments in courts across the country, with an overall win record of two for three. In addition to his appellate work, he frequently litigates challenges to federal administrative actions under the Administrative Procedure Act and to state laws and regulations under various provisions of the U.S. Constitution.
