Revelstoke Capital Partners' Investment in Family Care Center
Winston & Strawn LLP represented Revelstoke Capital Partners, a Denver-based private equity firm, in its investment in Family Care Center (FCC or the Company), a provider of outpatient psychiatry services to the U.S. Armed Forces, veterans, and the surrounding communities. Within its existing clinic footprint in Colorado Springs, Colorado, FCC provides mental health services to over 200 patients daily. The Company provides psychotherapy services, medication management, and transcranial magnetic stimulation, treating patients suffering from general anxiety disorder, major depressive disorder, post-traumatic stress disorder, and other chronic mental health conditions.

FTC and DOJ Host First Public Meeting of Pricing “Strike Force”
On July 31, 2024, the Department of Justice (DOJ) and the Federal Trade Commission (FTC) jointly hosted the first public meeting of the “Strike Force on Unfair and Illegal Pricing.” This initiative was launched by President Biden in March 2024 where he emphasized the readiness of the DOJ and FTC to enforce the law in response to “illegal pricing practices that are fraudulent or unfair or deceptive or anticompetitive.”

Motion To Dismiss for Lack of Personal Jurisdiction and Undue Delay in Service Denied
On March 28, 2022, Defendant Realtek Semiconductor Corporation (“Realtek”) filed a renewed motion to dismiss under Rule 12(b)(2) asserting that Plaintiff Bandspeed, LLP (“Bandspeed”) failed to make a preliminary showing that the court had personal jurisdiction over it. Realtek also sought to dismiss the case for undue delay in service and failure to prosecute under Rule 41(b).

TCPA is the abbreviation for the Telephone Consumer Protection Act of 1991. The law restricts telemarketing certain phone calls, text messages, and facsimiles. It also places restrictions on the use of automatic dialing systems and artificial or prerecorded voice messages. Collections’ actions by phone are also regulated under the act. Consumers may file complaints with Federal Communications Commission (FCC) when TCPA is violated. Since TCPA law governs consumer rights, lawsuits may also be filed by consumers who suffer violations.
