Rapid Ruling: Fifth Circuit Affirms Winston Win on Summary Judgment the Day After Oral Argument

Winston recently secured a total victory for our clients, KVP Energy Services, LLC and other affiliated defendants, at the U.S. Court of Appeals for the Fifth Circuit. Plaintiff BHI Energy I Power Services LLC filed suit in the U.S. Northern District of Texas in September 2022, alleging US$150M in damages in connection with causes of action for misappropriation of trade secrets, unfair competition, and various other business torts and statutory violations. Winston scored an important early win in January 2023 by defeating BHI Energy’s motion for preliminary injunction. After a year of extensive discovery, Winston moved for full summary judgment on behalf of all defendants. In a strongly worded opinion, the district court granted Winston’s summary judgment motion and dismissed the entirety of BHI’s lawsuit....Read more

What Is the Bureau of Ocean Energy Management (BOEM)?

The Bureau of Ocean Energy Management (BOEM) is the U.S. Government agency that leases offshore areas on the U.S. Outer Continental Shelf (OCS) for energy development, including offshore renewable energy such as offshore wind. The organization’s goal is to responsibly manage OCS energy and resources in the interest of energy independence, environmental sustainability, economic development, and national security. BOEM utilizes the expertise of scientists and technical professionals who share information and research that contributes to the bureau’s decision making. The bureau is part of the U.S. Department of Interior. BOEM’s sister agency—the Bureau of Safety and Environmental Enforcement or BSEE—enforces offshore safety, environmental and other requirements in tandem with BOEM issued leases and works closely with the U.S. Coast Guard and other federal and state agencies. BOEM has reported that OCS production accounts for approximately 18 percent of the nation’s crude oil supply and 4 percent of the domestic natural gas supply. BOEM is currently engaged in an extensive offshore wind leasing program with a number of leases already existing for wind farms off the U.S. East Coast....Read more

What Is the DMCA?

Passed in 1998 and implemented in 2000, the Digital Millennium Copyright Act (DMCA) updated U.S. law to meet the requirements of international copyright treaties. The DMCA addresses challenging issues relating to uses of copyrighted material in the digital environment: it limits the liability of online service providers that meet certain conditions, while providing certain procedures for addressing online infringement; it prohibits circumvention of digital technologies that control or limit access to copyrighted works; and it prohibits the removal or modification of certain types of copyright management information contained in protected works. Title II of the DMCA (sometimes also referred to as the Online Copyright Infringement Liability Limitation Act, or OCILLA) is codified at Section 512, Title 17, of the United States Code....Read more
