Ben is an accomplished antitrust attorney with extensive experience in both public service and private practice. He most recently served as Counsel to the Assistant Attorney General in the U.S. Department of Justice’s Antitrust Division, where he advised senior leadership on civil enforcement matters across sectors such as defense, transportation, energy, and agriculture. He led the Section 8 enforcement program and contributed to major cases, including United States v. Visa and United States v. Amex GBT, et al.

Ben also worked as a Trial Attorney in the Division’s Media, Entertainment, and Communications Section. There, he led investigations of potentially anticompetitive mergers and conduct, including a high-profile case involving NCAA rules and a complex ed-tech platform merger. He also played a key role in United States v. Booz Allen Hamilton and United States v. Assa-Abloy, earning multiple Assistant Attorney General Awards.

Earlier in his career, Ben served as an Attorney Adviser at the U.S. International Trade Commission, supporting Chief Administrative Law Judge Clark S. Cheney on intellectual property investigations. He began his legal practice at Kellogg, Hansen, Todd, Figel & Frederick, where he litigated antitrust and IP cases for U.S. and Japanese clients.

  • In re Dealer Management Systems Antitrust Litigation, 1:18-cv-00864 (N.D. ) – Represented class and individual plaintiffs in complex antitrust multi-district litigation with copyright, DMCA, theft of trade secrets, and computer fraud counterclaims.
  • IQVIA v. Veeva Systems, Inc., 2:17-cv-00177 (D.N.J.) – Defended a life-sciences CRM software-as-a-service company in theft of trade secrets litigation, with antitrust and unfair competition counterclaims.
  • MiiCs & Partners America v. Funai Electric Co. Ltd., 1:14-cv-804 (D. Del.) – Defended a Japanese television manufacturer in a patent suit.
  • Steuben Foods, v. Shibuya Hoppmann Corp., 1:10-cv-00781 (W.D.N.Y.) – Defended a Japanese manufacturer of industrial filling machines for low-acid packaged foods in a patent suit.
  • Zukerman USPS, 1:15-cv-2131 (D.D.C.) Represented an artist, pro bono, in a successful first amendment challenge to viewpoint discrimination in the administration of a custom postage program.

Education

Benjamin received his J.D., cum laude, from Cornell Law School in 2014, where he was an Articles Editor of the Cornell Law Review and the Vice Chancellor of International Competition & Bench Editor of the Moot Court Board. He received his B.A., cum laude, from Northwestern University in 2011, and was both a Brady Scholar in Ethics and Civic Life and Kaplan Humanities Scholar.
