Key Matters
- Defended a pet food manufacturer that advertised the use of "wild-caught" fish and "free-run" poultry as ingredients in class action litigation alleging these descriptions were misleading and violated Washington and Illinois consumer protection laws.
- Defended an international rental car agency in false arrest litigation and commercial disputes involving breach of contract. Assisted in securing summary judgment, which was affirmed by Florida's Fourth District Court of Appeal.
- Secured dismissal of a complaint without leave to amend against a medical device company accused of federal securities violations.
- Secured dismissal of a complaint filed against a manufacturer of Mexican-style popsicles known as "paletas" in a class action lawsuit alleging product packaging deceptively advertised the origin of the product in violation of Florida's Deceptive and Unfair Trade Practices Act (FDUTPA) and Florida's false advertising law.
- Defended an individual accused of various accounting malpractice and fraud claims in connection with annual financial audits. Following multiple rounds of motion practice and discovery, which reflected no support for the plaintiffs' speculative damages theory, the plaintiffs voluntarily dismissed the case.
