Edward A. Day
Associate
Ted relies on his prior experience clerking at the federal trial and appellate levels to serve clients facing challenging issues at any stage of the litigation process.
A former federal law clerk, Ted ensures that strategy is aligned at every stage of the litigation process, from prelitigation through appeal. Ted has first chaired depositions, argued motions, prepared fact and expert witnesses for trial, and cross-examined witnesses in jury and bench trials. Ted has also briefed motions to dismiss, summary judgment motions, pre-trial and post-trial motions, and appeals.
Ted was the lead associate on key wins including a summary affirmance before the United States Court of Appeals for the Federal Circuit on jury right and procedural issues, state court affirmances of eight- and nine-figure judgments in Delaware and New York shareholder disputes, and a New York bench trial win determining the impact of state legislation on an M&A earnout provision. He also served as the trial team’s lead appellate preservation associate in a landmark defamation lawsuit in Delaware that settled on the eve of opening statements.
Ted has a robust pro bono practice. He has represented indigent plaintiffs in 42 U.S.C. § 1983 litigation, drafted federal amicus briefs for nonprofit organizations, and negotiated special needs services on behalf of a neurodiverse child in partnership with a Chicago-based disability rights organization. Before entering private practice, Ted served as a law fellow with the Legal Aid Society of Metropolitan Family Services, representing low-income tenants in the Cook County courts, and interned with the Cook County States’ Attorney’s Office’s Criminal Appeals division.
