Winston & Strawn's recent representation of two families, the Evanses and the Hernandezes, who shared similar encounters with the Department of Children and Family Services (DCFS) was featured in the "Non-billable Hours" section of Chicago Lawyer.

In both cases, parents of an injured child took the minor to a doctor and the doctor became concerned over the explanation of the child's injuries. As a result, both children were taken from their parents by DCFS. But after full investigations, the agency found no evidence of child abuse in either case.

Winston's team settled the Evans case after defeating a motion to dismiss. After they lost the Hernandez case on summary judgment, they took the case to the 7th U.S. Circuit Court of Appeals, where they secured reversal and remand. They settled that case earlier this year.
