Winston & Strawn Obtains Patent Victory for LogMeIn, Inc. in Eastern District of Virginia

On March 26, 2013, after a six-day trial in a patent case involving products worth hundreds of millions of dollars, a Virginia jury delivered a major victory for Winston & Strawn client LogMeIn, Inc.
LogMeIn, the second largest company in the remote computer access space, was sued by one of its competitors, 01 Communique, for more than $115 million, plus a permanent injunction and/or future damages.
The history of the remote access technology stretches back to the mid-1990's, and the patent itself to 2005. In 2010, 01 Communique sued LogMeIn (along with co-defendant Dell) for infringement of a remote computer access patent in the Eastern District of Virginia.
Winston & Strawn began as counsel for Dell. After Winston & Strawn successfully had Dell dismissed from the case, WilmerHale, representing LogMeIn, engaged the firm to assist. Winston & Strawn initially served as local counsel, and ultimately as co-counsel for trial.
After deliberating for less than three hours, the jury concluded that there was no infringement, no willful infringement and no damages. LogMeIn's stock rose 16% upon announcement of the verdict, while 01 Communique's stock dropped 64%.
