Winston & Strawn and Econ One presented a seminar titled "Damages in International Arbitration" on June 21, 2012, at the Paris office of Winston & Strawn.

Damages and their valuation are key concerns in international arbitration proceedings. Damages give rise to a wide range of issues, some of which are novel. Ascertaining the losses and assessing them accurately is crucial for achieving the desired outcome.

This seminar included:

  • Introduction to damages in international arbitration
    • Assessing your losses early
    • Collecting proof of your losses
    • Punitive damages in the civil and common law systems
    • Duty to mitigate damages
    • Award of costs
  • Quantifying damages in international arbitration
    • How can one project the revenues that a concern could have obtained but for a breach of contract or an expropriation? Should one rely on actual performance in years past? Or on internal business plans prepared prior the breach of contract or the expropriation?

Maria Kostytska, of counsel in the Paris arbitration department, moderated the program. Winston & Strawn also welcomed Mr. Daniel Flores, senior economist of EconOne, as well as Mr. Ettore Cami and Mr. Andrea Cardani, consultants at EconOne.
