On May 4, a former Winston & Strawn Partner spoke at the 2022 Litigation Section Annual Conference in Miami, Florida, in a session titled “The Ethical Use of Expert Witnesses.”

The presentation explored the ethical issues related to the use of expert witnesses in dispute resolution. Topics included:

  • Rules of professional conduct applicable to presenting witnesses generally

  • How to ethically prepare and use an expert witness

  • Interacting with your opponent’s experts

  • The difference between consulting experts and testifying experts, and implications with respect to discovery

  • The ethical and practical constraints on expert witnesses themselves, particularly when the expert is an attorney
