CORPORATE TRANSPARENCY ACT UPDATE — CARL FORNARIS

Top legal advisers discussed the now-in-effect U.S. federal beneficial ownership information reporting regulation that implements the Corporate Transparency Act. The panel provided updates on the ultimate beneficial ownership information reporting requirements for privately held corporations, limited liability companies and other similar entities created in, or registered to do business in, any of the states of the United States.

VALUE AND CHALLENGES OF SANCTIONS AND THE RISKS OF DOING BUSINESS IN THE REGION — MARIANA PENDÁS

Mariana and Tyler Carruth, Policy Advisor of the Office of Terrorist Financing and Financial Crimes, discussed government strategy in the region, along with challenges faced by the private sector concerning the implementation of sanctions. The discussion covered the government’s perspective relating to sanctions value in fighting narcotics trafficking and corruption in the region, as well as enhancing democracy. The panel also addressed the practical challenges faced by financial institutions and their underlying customers, such as enacting efficient risk-based compliance programs, the geographic proximity to sanctioned jurisdictions (Cuba, Venezuela, and Nicaragua) and the commercial proximity to other risky jurisdictions (Iran, China, and Russia).
