Winston Achieves a String of Wins for Client Hikma Pharmaceuticals

A Winston & Strawn team recently obtained a significant victory for the firm’s client Hikma Pharmaceuticals, convincing the Delaware federal district court to grant summary judgment on Takeda’s claims for patent infringement concerning Hikma’s gout prophylaxis medication branded as Mitigare® (colchicine). Judge Andrews held that Takeda’s arguments relied on speculation, and a reasonable jury could not return a verdict for Takeda. 

Takeda’s patent litigation in Delaware began more than four years ago, when it enjoyed initial success with a temporary restraining order. But Winston convinced the Delaware court to deny Takeda’s motion for a preliminary injunction as well as the Federal Circuit to affirm that decision. Winston also helped Hikma prevail on Takeda’s related challenges against the FDA under the Administrative Procedure Act filed in the District of Columbia federal court.
