Sean Wieber, partner and co-chair of Winston’s Regulated Personal Information (RPI) practice group, discussed a recent Illinois Supreme Court case ruling that raises the stakes for business owners facing massive biometric privacy damages in an article for Law360. The court must next decide whether those damages accrue for every day a company demands an employee’s fingerprint without consent or just the first such violation.

“There’s a lot of small mom-and-pop shops, good businesses that have been on the brink of bankruptcy or had to make tough decisions during a pandemic, and then they get hit with these cases, where there are not a lot of defenses,” Sean said.
