Winston & Strawn partner Ron Rothstein spoke at the 2012 ABA Annual Meeting as part of a CLE program for the Antitrust Law section on Friday, August 3, 2012. Mr. Rothstein spoke on the panel titled, "Government Cases and Class Actions: Making and Breaking the Links."
This panel discussed the various advertising cases throughout the country that have seen results in the millions or the class actions that are quickly dismissed. A panel consisting of prosecutors and litigators – for both plaintiffs and defendants – assessed the cases, the trends, and the reasons why some respondents find repose and others fight follow-on lawsuits long after the FTC is done. The panel examined such factors as the FTC's legal theories, the latest First Amendment decisions in commercial speech, and the pros and cons of removal.
Moderating the panel was Amy Mudge, from Venable LLP and joining Mr. Rothstein as panelists were Timothy J. Muris, from Kirkland & Ellis LLP; David C. Vladeck, Director, Bureau of Consumer Protection, Federal Trade Commission; and Barry C. Barnett, from Susman Godfrey LLP.
