UNSTACKING THE DECK: BUILDING DEFENSE WINS IN A PLAINTIFF-FRIENDLY PRODUCTS AND MASS TORTS WORLD

The legal landscape of product liability and mass torts law is continuously in flux, and the plaintiffs’ bar is prepared to use that to its advantage. On June 7, Winston & Strawn hosted its annual Product & Mass Torts Summit, which explored effective strategies for taking advantage of those changes and combating plaintiffs’ maneuvers.

The Summit started with the pre-litigation stages of the compliance curve on EPA, FDA, and other federal regulations. Next, we explored strategies for evaluating scientific evidence and its role in causation defenses and discussed evolving tactics in MDLs, including the trend of public nuisance claims. Moving into the courtroom, Winston’s leading trial lawyers provided insight into preparing corporate witnesses for trial and setting up appeals. The Summit’s final panel brought together Fortune 500 in-house counsel for their perspectives on the realities of mass torts litigation.
