Winston & Strawn joined ACC South Florida for its 13thAnnual CLE Conference on September 29, 2023.
Partner Nicholas Rodriguez spoke on a panel titled “Navigating ESG Landmines and Pitfalls: A Race to Compliance.” The discussion covered the importance of ESG initiatives and compliance, including key components of ESG trends and reporting requirements important to in-house attorneys when thinking about ESG.
Nicholas encouraged companies to utilizie a robust, multidisciplinary team of internal experts to lead their ESG programs in light of announced international standards, forthcoming SEC rules, and ever-changing state laws.
He warned of the various regulatory, reputational, and legal risks that companies face by maintaining inadequate ESG compliance programs.
Nicholas further emphasized the importance of capturing the necessary data and implementing comprehensive processes and procedures in preparation for SEC, CSRD, and ISSB disclosures starting in 2024.
Noting the increased scrutiny of greenwashing by regulators & the plaintiff’s bar, he discussed how some companies have turned to “greenhushing” to mitigate any potential adverse responses.
