June 6, 2022

On June 6, Winston & Strawn International Arbitration Partner Matthew Bate spoke on a panel titled “Creating Effective Memorials and Witness Statements in International Arbitration” at Practising Law Institute’s International Arbitration 2022 conference in New York.

If your company or client has a dispute arising from a contract with a foreign party, international arbitration represents the best method of resolving that dispute in a neutral forum and enforcing any subsequent award. Matthew Bate and other panelists discussed critical issues and provided information needed to successfully navigate the international arbitration process such as:

  • How to interview witnesses effectively
  • Selecting the right witnesses for your case
  • Preparing reliable witness statements and memorials
  • Discussing what goes into the memorial versus the witness statement
  • Exploring whether you can eliminate witness statements

Speakers shared their insights and experience on drafting pleadings and memorials, conducting document disclosure, preparing witness statements, conducting effective cross-examinations, and presenting expert evidence, all in a “round table” style format.

As the round tables revealed, international arbitration is a hybrid between common law and civil law procedures, and advocates should be live to the significant differences with U.S. court litigation.

The entire program is still available for viewing on PLI’s online platform (www.pli.edu) and viewers can earn CLE credits.
