Paris-based International Arbitration Partner Maria Kostytska presented “An ‘Ideal’ Arbitration Clause: Options for Negotiating” on November 19. The event was presented by Winston & Strawn in connection with Le Moci magazine.

In the negotiation of international contracts, the dispute resolution clause or “midnight” clause is too often discussed at the last minute. Yet when a dispute arises, it is this clause that is first to be scrutinized, praised, or criticized. Indeed, the consequences of a poorly negotiated or written clause can be devastating to a company, both in terms of efficiency and costs. In the presentation, Ms. Kostytska sketched an ideal arbitration agreement, offered writing tips, and compared negotiating tips.
