Managing Through the “Next” Normal Webinar

On May 21, Winston & Strawn and the Association of Corporate Counsel of Southern California hosted a webinar discussion exploring the “next” normal, as businesses begin to emerge from the shutdown caused by the COVID-19 pandemic. In the wake of major shifts in how business is conducted, the panelists discussed recent changes in law affecting small and large companies and forecast best practices regarding changes yet to come. Additionally, they also explored how legal departments can add value in the face of these changes and lead their organizations through the next normal.

Highlights of the presentation addressed:

• Labor & Employment: Understanding and preparing for unintended consequences of new regulations put on employers; clarifying the misconceptions of furloughing employees and remote work expense reimbursements; and succession and workforce planning outside the C-suite.
• M&A/Transactional/Commercial Contracts/Corporate Governance: Throwing away “standard template” contracts for a more strategic bespoke approach in uncertain times; preparing to hit the ground running when deals resume; considering various stakeholders in the next normal; and exploring governance in uncertain times.
• Privacy & Cybersecurity: Arming your remote workforce with the privacy tools needed to protect company and customer data; and developing a proactive response plan against cyberattacks and threats.
• Litigation: Navigating the disruption to pending actions and using remote tools to avoid stalling case schedules; protecting against liability as businesses respond to COVID-19 and the projected spike in lawsuits; and addressing budgetary concerns.
