Kathi Vidal Discusses IP Litigation Increases in Texas

Winston & Strawn Silicon Valley Office Managing Partner Kathi Vidal shared her thoughts with The Texas Lawbook on how Texas–most notably, the Eastern District of Texas–has for many years been a focus of patent litigation.
In fact, in the first six months of 2020, there were more than 700 patent suits filed in the four federal court districts in Texas. Data shows that amount has doubled since the same time period in 2019, and is twice as many as were filed in any other state this year.
Kathi also offered insights into the continued wave of patent cases in Texas, especially with Judge Alan Albright in the Western District of Texas.
“People don’t file motions if they know he is going to deny them,” she said. “He’s very transparent. He has never invalidated a patent [under 35 USC 101]. And you know if you file your case in Waco, you will get Judge Albright.”
